We inform you that the website https://planketogenic.pro (hereinafter, the “Platform”) is owned by Healthy Custom Diets S.L. (hereinafter referred to as "PLANKETOGENIC"), with VAT number B88430285 and domiciled office at Calle Sagasta Nº 30, Piso 7 Drcha , 28004 Madrid, Spain, registered in the Mercantile Register of Madrid in Volume 39437, Folio 2, Section 4, Page M-700151, I/A 1 (2021/134.191,0).

Access and / or use of the Platform grants you the status of user, and you accept, from such access and / or use, this Legal Notice.

The User assumes responsibility for the use of the Platform. The Platform can provide access to a multitude of texts, graphics, drawings, designs, photographs, videos, multimedia content, and information (hereinafter referred to as the "Content"), belonging to PLANKETOGENIC or third parties to which the user can have access.

The User agrees to make appropriate use of the Content and services offered through the Platform and, including but not limited to, not to use them for:

1. Engage in illegal activities, or contrary to good faith and public order.
2. Cause damage to the physical and logical systems of the PLANKETOGENIC Platform, its suppliers or third parties.
3. Introduce or spread computer viruses or any other physical or logical systems that may cause the damage.
4. Trying to access, use and/or manipulate PLANKETOGENIC data from third party providers and other users.
5. Reproduce or copy, distribute, allow public access through any form of public communication, transform, or modify the Contents, unless authorized by PLANKETOGENIC.
6. Deleting, hiding, or manipulating the Contents subject to intellectual or industrial property rights and other data identifying such rights of PLANKETOGENIC or third parties incorporated into the Contents, as well as the technical protection devices or any information mechanisms that may be inserted into the Contents.

PLANKETOGENIC warns that the materials contained in this Platform have been included only for information purposes and are therefore insufficient for making decisions or assuming positions in a specific case.

The User must bear in mind that the materials contained in this Platform may not reflect the most recent legislative or jurisprudential status on the issues analysed. Also, these materials can be modified, developed, or updated without notice.

PLANKETOGENIC shall have the right to investigate and report any of the conduct in accordance with the law, as well as to collaborate with the authorities in the investigation of such actions.

PLANKETOGENIC may temporarily suspend access to the Platform without prior notice for maintenance, repair, updating or improvement purposes. However, whenever circumstances allow it, PLANKETOGENIC will inform the User, with sufficient notice, of the date foreseen for the suspension of the services. PLANKETOGENIC is not responsible for the use that Users may make of the Content included on the Platform.

All intellectual property rights over the content and graphic design of this Platform (including, but not limited to, images, sound, audio, video, software or texts; brands or logos, color combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, etc.) are the exclusive property of PLANKETOGENIC or of a third party that PLANKETOGENIC has authorized its use. Therefore, PLANKETOGENIC has the exclusive right to exploit said contents and graphic design.

Therefore, by virtue of the provisions of Royal Legislative Decree 1/1996, of 12 April, which approves the Revised Text of the Intellectual Property Law, and Law 17/2001, of 7 December, on Trademarks, as well as any other complementary legislation on intellectual and industrial property, the reproduction, transmission, adaptation, translation, distribution or public communication, including making available or any other form of commercial exploitation and/or modification of all or part of the content of the Platform is prohibited, except with the express prior authorisation of PLANKETOGENIC.

PLANKETOGENIC does not grant any license or authorization of use any of its intellectual and industrial property rights or any other property or right related to the Platform and/or the Services or Contents.

The User undertakes to respect the Intellectual and Industrial Property rights owned by PLANKETOGENIC. In this sense, the reproduction and temporary storage of the contents of the Platform is permitted to the extent strictly necessary for the use and viewing of the Platform from a personal device.

The legitimacy of the intellectual or industrial property rights corresponding to the Content provided by users is the sole responsibility of the users themselves, so the User shall hold PLANKETOGENIC harmless from any third-party claim arising from the unlawful use of Content on the Platform.

The use of this Platform may require Users to provide personal data. PLANKETOGENIC treats this type of information in accordance with the applicable legislation and includes it in its Privacy Policy.

PLANKETOGENIC declares that it has adopted all the necessary measures within its possibilities, and taking into account the current state of technology, to allow the correct functioning and absence of viruses and harmful components on its Platform.

However, PLANKETOGENIC cannot be held responsible for:

1. the lack of continuity and availability of the Content and Services;
2. the presence of errors in said Content or the failure to correct any defects that may exist;
3. the veracity, integrity or updating of the data provided by Users;
4. the interruption of the operation of the Platform or computer faults, telephone breakdowns, disconnections, delays or blockages caused by deficiencies or overloads in the telephone lines, data centers, in the Internet system or in other electronic systems, produced in the course of its operation;
5. the presence of viruses or other harmful components; and
6. any damage caused by third parties who infringe or violate the security systems of PLANKETOGENIC.

PLANKETOGENIC may temporarily suspend, without prior notice, access to the Platform for maintenance, repair, updating or improvement operations. However, whenever circumstances allow it, PLANKETOGENIC will inform the User, with sufficient notice, of the date scheduled for the suspension of the Services.

PLANKETOGENIC is not responsible for the use that Users may make of the Content included on the Platform.

This Legal Notice shall be in force indefinitely, and PLANKETOGENIC may make changes to the conditions specified in it, which shall come into force from the time of its publication

PLANKETOGENIC may delete, add or change both the Contents and the services it provides, as well as the way in which they are located or presented. The conditions published at the time the User accesses the PLANKETOGENIC Platform are understood to be in force.

Access and / or use of the Platform shall be understood as acceptance by the User of this Legal Notice and its conditions and, where appropriate, any changes made to them.

PLANKETOGENIC does not assume any responsibility for links of other third parties’ applications or websites that may exist on the PLANKETOGENIC Platform and may direct the User to other applications or websites over which PLANKETOGENIC has no control.

In this sense, PLANKETOGENIC is not responsible for the information contained in these third parties’ links or for any effects that may derive from such information.

Therefore, the inclusion of links to other websites or applications does not imply endorsement of their contents by PLANKETOGENIC or the existence of any association between PLANKETOGENIC and their owners.

Consequently, the User accesses to this Content under his own responsibility and under the conditions of use that govern them.

This Legal Notice constitutes an agreement between each of the Users and PLANKETOGENIC.

If the competent authority declares a provision to be illegal, invalid, or inapplicable, such declaration with respect to one or more clauses shall be without prejudice to the validity of the other clauses.

The fact that PLANKETOGENIC does not require strict compliance with any of the provisions of this Legal Notice does not constitute nor can it be interpreted in any way as a waiver on your part to require strict compliance in the future. 

PLANKETOGENIC will pursue the breach of this Legal Notice, as well as any misuse of its Platform, exercising all civil and criminal actions that may apply by law.

PLANKETOGENIC may make appropriate communications through the email address provided by the Users in the registration forms or through any other means provided in the contact data of the User.
